2. TERMS & CONDITIONS

Booking & Retainers

Photography services are not considered officially reserved until any required retainer, deposit or signed agreement has been received.

Retainers are non-refundable unless otherwise stated in writing. Remaining balances are due no later than the agreed-upon payment date communicated before the session. Failure to complete payment may result in cancellation of services, delayed delivery or withholding of final galleries.

Cancellations & Rescheduling

Clients are responsible for notifying Polston Photography as soon as possible regarding cancellations or rescheduling requests.

Polston Photography reserves the right to approve or deny rescheduling requests based on availability. Outdoor sessions may be rescheduled due to unsafe weather conditions, environmental hazards or circumstances beyond reasonable control.

Session Conduct

Polston Photography reserves the right to immediately terminate services without refund in situations involving:

-Unsafe environments

-Illegal activity

-Harassment

-Threatening behavior

-Disrespectful conduct

-Conditions that place equipment or individuals at risk

Artistic Style: By booking services, clients acknowledge familiarity with the artistic style, editing approach and overall aesthetic represented within the Polston Photography portfolio. Final image selection and editing decisions remain at the sole artistic discretion of Polston Photography.

RAW Files & Editing: RAW, unedited or unfinished files are not delivered under standard photography services. Clients may request limited revision adjustments within a reasonable timeframe after gallery delivery. Extensive retouching or additional editing requests may result in additional fees.

Turnaround Times: Estimated delivery timelines vary depending on project scope, workload, holidays and seasonal demand. Polston Photography will make reasonable efforts to meet communicated turnaround estimates but does not guarantee exact delivery dates unless explicitly agreed upon in writing.

Image Delivery & Storage: Final images are generally delivered through a digital online gallery. Clients are responsible for downloading and backing up delivered files. Polston Photography is not responsible for maintaining long-term file storage after gallery delivery.

Travel & Additional Fees: Travel fees, permit fees, parking expenses or location-related charges may apply depending on session location.

Applicable fees will be communicated prior to booking confirmation whenever possible.

3. COPYRIGHT & IMAGE USAGE POLICY

Copyright Ownership: All photographs, graphics and creative content produced by Polston Photography remain the intellectual property of Polston Photography and are protected under United States copyright law. No image may be copied, reproduced, altered, sold, redistributed, published or commercially used without prior written permission.

Personal Usage Rights: Clients are granted non-transferable personal-use rights for delivered photographs. Permitted personal usage includes:

-Personal printing

-Social media posting

-Sharing with friends and family

-Personal display

Prohibited Usage: Clients may not:

-Sell images

-Submit images to contests without permission

-Alter images beyond basic cropping for social media formatting

-Apply filters or edits that misrepresent the photographer’s work

-Remove visible watermarks or credits

-Use images for business, advertising or commercial promotion without written licensing approval

Social Media Sharing:

Clients are welcome to share delivered images online. Credit to Polston Photography is appreciated whenever possible.

Portfolio & Promotional Rights: Polston Photography reserves the right to use images from sessions for:

-Portfolio display

-Website content

-Social media promotion

-Marketing materials

-Educational purposes

-Competitions

-Publications

Clients requesting privacy or non-disclosure regarding session images must communicate those requests in writing before the scheduled session date.

4. LIMITATION OF LIABILITY

Polston Photography is not liable for circumstances outside reasonable control including but not limited to:

-Weather conditions

-Venue restrictions

-Delayed client arrival

-Failure of subjects to cooperate

-Obstructed views

-Acts of nature

-Technical malfunctions beyond reasonable preventative measures

-Third-party vendor issues

In the unlikely event that services cannot be completed due to emergency, illness, equipment failure or unforeseen circumstances, liability shall be limited to the total amount paid by the client. Polston Photography shall not be responsible for indirect, incidental or consequential damages.

Polston Photography strives to maintain a website experience that is accessible and user-friendly for all visitors. Individuals experiencing difficulty accessing website content are encouraged to reach out directly for assistance.

Requests for exact recreations of reference images, poses or editing styles are not guaranteed.

8. AI & DIGITAL IMAGE PROTECTION

Images created by Polston Photography may not be used for:

- Artificial intelligence training

-Machine learning datasets

-Synthetic media generation

-Facial recognition databases

-Unauthorized digital manipulation

without prior written permission. Polston Photography reserves all rights regarding digital image reproduction and emerging technology usage.

9. PRINT QUALITY DISCLAIMER

Polston Photography is not responsible for print quality, color inconsistencies, cropping variations or product defects resulting from third-party printing services not directly provided or recommended by Polston Photography. Final image appearance may vary depending on screen calibration, printer settings, paper type and external production processes.

10. GOVERNING LAW

These policies, terms and conditions shall be governed and interpreted in accordance with the laws of the State of Nevada. Any disputes arising from photography services, website usage or contractual agreements shall be handled within the appropriate jurisdiction of Clark County, Nevada.
